1. Agreement

By creating an account or using Kioku Brain, you agree to these Terms.

2. Service description

Kioku Brain is an AI-native spaced-repetition memory tool. Features include card generation from text/URL/PDF, FSRS-5 scheduling, AI replay variants, cross-lingual links, and email reminders.

3. Plans and billing

• Free: 50 cards/month, limited AI features. No card required.
• Pro Monthly: $12.99/mo via Stripe, recurring, cancel anytime.
• Pro Annual: $99/yr via Stripe, recurring annually.
• Lifetime: $249 one-time, limited to first 200 buyers.

All prices in USD, exclusive of applicable taxes (JCT for Japan, VAT for EU/UK).

4. Refunds

14-day refund window. See refund policy.

5. Acceptable use

• Do not upload illegal, infringing, or malicious content.
• Do not attempt to bypass rate limits, quotas, or abuse the AI generation features.
• Do not scrape, mirror, or republish other users' cards.
• One person, one account. Sharing account credentials is prohibited.
• We may suspend or terminate accounts violating these rules.

6. AI-generated content

Cards generated by AI may contain errors. You are responsible for verifying factual correctness, especially for medical, legal, or safety-critical learning material.

7. Intellectual property

• You retain ownership of the source content you upload.
• You grant us a limited license to process your content solely to provide the service (no training, no resale).
• The Kioku Brain name, logo, and software are our property.

8. Limitation of liability

The service is provided "as is" without warranty. To the maximum extent permitted by law, our total liability is limited to the amount you paid us in the past 12 months. We are not liable for lost profits, data, or indirect damages.

9. Termination

You may delete your account anytime. We may suspend accounts that violate these Terms, with at least 7 days notice except for fraud, abuse, or legal compliance.

10. Governing law

These Terms are governed by the laws of Japan. Disputes will be resolved in the Tokyo District Court.

11. Changes

We may update these Terms with 14 days' email notice. Continued use after the effective date means acceptance.
